No, the DHCP server is doing exactly what it should in that case.   In 
order to reclaim those expired leases, you have to put the surviving server 
into the partner-down state.   It would actually be a nice tweak to the ISC 
server if, when it encountered a disk I/O error, went into the shutdown 
state and stayed there until the disk came back, but this feature has not 
been implemented.
