pfBillBoard picking

I am trying to pick a pfBillboard but for some reason the pick routine picks the object behind the bill board if there is one, else picks null. The mode is set to pick the nearest so that is not the problem.

Is there a problem picking pfBillboard?

The billboard is a single square polygon.
