OK, here's what I did:

(1) got CVS directory following instructions on web page
(2) made a patch with diff using the following:

diff -urN --exclude=CVS /usr/src/linux-2.4.17/ /usr/src/linux-2.4-xfs/linux/ > 
/tmp/patch

BINGO - fresh patch! Very nice.
