I'm afraid I don't understand what is exactly happening for you.
It would be nice to see a printout of the acl's using getfacl on each
of the files.
I presume:
user fred owns/created the file data.txt
user jack tries to save data.txt using msoffice and creates a new file
data2.txt.
What do you mean by "default rights"?
So we have a new files data2.txt with (user:jack:r--).

What does that sentence mean?
Does it mean the owner can't write to the file either even though
he has rwx permissions (user::rwx) ?
Hmmmm...
It'd be nice to know who did what and what the resultant file
was and what the resultant acls on the file was.
And then what the problem was -
was the resultant acls on the file not expected or the acls
were right but the access checking seemed to do the wrong thing...
