Why is the tulip.c in the 2.3 kernels older than the 2.2.14?

I am able to pass large ethernet vlan packets with my tulip.c compatible
ethernet card in 2.2.13/14.

However, in the 2.3.42 kernel, I get frame_errors (because the frame is
4 bytes larger when the pkt is MTU sized.)  Same hardware....

I noticed that the tulip.c in the 2.3.42 kernel is older than the
2.2.14 version.

Does anyone have a newer tulip.c that is ported to the 2.3 kernel?
I downloaded the "tulip.c:v0.91g 7/16/99 becker@xxxxxxxxxxxxxxxxxxxx\n";
version, but it won't compile cleanly...
